These Terms of Use ("Terms") govern your access to and use of Homees.ca, including all websites, mobile applications, tools, reports, calculators, content, property information, AI-powered services, and related services operated by Homees.

By accessing or using Homees, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use Homees.

Homees is a real estate technology platform designed to help users research, evaluate, and make more informed real estate decisions.

Homees provides:

• Property information
• Home valuation tools
• Affordability calculators
• Mortgage-related tools
• Property analysis reports
• AI-powered insights
• Market intelligence
• Educational content
• Connections to licensed professionals

Homees is not a real estate brokerage.

Unless a separate written agreement exists, using Homees does not create:

• A client relationship
• A representation relationship
• A designated representation relationship
• An agency relationship
• A fiduciary relationship
• A brokerage relationship

Any professional services are provided separately by licensed professionals under separate agreements.

You must be at least 18 years of age to use Homees.

By using Homees, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into these Terms;
• Information you provide is accurate and complete;
• You will use Homees only for lawful purposes.

Certain features may require account registration.

You agree to:

• Provide accurate information;
• Maintain accurate account details;
• Protect your password and credentials;
• Notify Homees immediately of unauthorized access.

You are responsible for all activity associated with your account.

Subject to these Terms, Homees grants you a limited, revocable, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes.

All rights not expressly granted are reserved by Homees.

You agree not to:

• Copy or reproduce Homees content without permission;
• Scrape, harvest, download, mine, or extract data from Homees;
• Use bots, crawlers, spiders, or automated systems;
• Reverse engineer platform functionality;
• Interfere with platform security;
• Impersonate another individual or organization;
• Submit false or misleading information;
• Use Homees for unlawful purposes;
• Attempt to gain unauthorized access to systems or accounts.

Violation of these restrictions may result in suspension or termination of access.

Property information displayed on Homees may originate from public records, third-party providers, builders, developers, users, or other sources.

Property information may contain:

• Errors
• Omissions
• Delays
• Inaccuracies
• Outdated information

Homees does not guarantee:

• Availability
• Pricing
• Incentives
• Occupancy dates
• Taxes
• Maintenance fees
• Square footage
• Property specifications

Users should independently verify all information before making decisions.

Homees may use artificial intelligence and machine learning technologies to generate:

• Property reports
• Market insights
• Valuation estimates
• Affordability analyses
• Recommendations
• Comparisons

AI-generated information may be incomplete, inaccurate, outdated, or unsuitable for your circumstances. Users should not rely solely on AI-generated content when making legal, financial, investment, mortgage, or real estate decisions.

Home valuation estimates are automated estimates only. They are not:

• Appraisals
• Comparative Market Analyses
• Broker Opinions of Value
• Professional valuation services

Actual property values may differ significantly.

Information provided through Homees is for informational and educational purposes only. Nothing on Homees constitutes:

• Legal advice
• Financial advice
• Tax advice
• Mortgage advice
• Investment advice
• Real estate advice

Users should consult qualified professionals before making decisions.

To the fullest extent permitted by law, Homees, its owners, operators, affiliates, employees, contractors, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or economic damages arising from:

• Use of Homees;
• Reliance on information;
• AI-generated content;
• Property information inaccuracies;
• Service interruptions;
• Data loss;
• Third-party services.

Your use of Homees is entirely at your own risk.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

The trademarks MLS®, Multiple Listing Service® and the associated logos identify professional services rendered by REALTOR® members of The Canadian Real Estate Association (CREA) to effect the purchase, sale and lease of real estate as part of a cooperative selling system. The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA.

Listing data displayed on Homees is sourced from the AMPRE (Alberta MLS® Property Resource Exchange) data syndication program and other regional MLS® feeds operated by CREA member boards. This data is provided under license and is subject to syndication terms, data refresh schedules, and availability limitations set by CREA and its member boards.

As a result of these data syndication limitations:

• Listing information may not reflect real-time availability, price changes, or listing status;
• Some listings, images, or property details may be delayed, incomplete, or omitted;
• Homees does not guarantee the accuracy, completeness, or currency of any listing data;
• Sold, expired, or suspended listings may appear on the platform for a period of time after their status change.

Indemnification - Data Inaccuracy: By using Homees, you agree to indemnify, defend, and hold harmless Homees, its owners, affiliates, officers, employees, agents, data providers, and licensors from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from or relating to:

• Your reliance on listing data, pricing, availability, or property details displayed on Homees;
• Inaccuracies, delays, or omissions in MLS® or AMPRE-sourced data;
• Any decision - financial, legal, or otherwise - made based on information presented on Homees;
• Your breach of these Terms or applicable data syndication rules.

Users are strongly encouraged to independently verify all listing information directly with the listing brokerage or a licensed real estate professional before making any offer, purchase, or lease decision.
